Length of Suspension in New York

According to the NYS DMV, the length of the suspension depends on the violation and whether or not it was a repeat offense.

Such offenses include but are not limited to:

90-Day Suspension:

  • Driving while ability impaired by alcohol (DWAI)

Six-Month Suspension:

One-Year Suspension:

  • Aggravated DWI (.18% BAC or higher or with child 15 years or younger in vehicle)
  • DWI (.08% BAC or higher) or DWAI-Drug committed within 10 years of any previous violation
  • First-time drug- or alcohol-related offense by a driver under 21 (Zero Tolerance law excepted)

Penalties for Aggravated Unlicensed Operation

Knowingly driving with a suspended license is known as aggravated unlicensed operation (AUO). Laws regarding this offense are found in N.Y. VTL §511, where it states that AUO can be committed in three degrees:

Third Degree Offense:

  • Misdemeanor
  • $200-$500 fine and/or imprisonment for up to 30 days

Second Degree Offense:

  • Misdemeanor
  • $500-$1,000 fine and/or imprisonment for up to 180 days

First Degree Offense:

  • Class E felony
  • $500-$5,000 fine and/or imprisonment for up to four years
