What New York Law Defines as Street Racing
VTL §1182 prohibits engaging in, aiding, or abetting any motor vehicle race, exhibition, or contest of speed on a public highway without a permit. The key word is “contest.” Prosecutors must show the drivers planned or impliedly agreed to race. Simply driving fast alongside another vehicle doesn’t establish that agreement on its own. Courts have recognized this distinction, and it forms the foundation of many viable defenses.
The statute also reaches beyond the driver. A passenger or bystander who aids or abets the event can face the same charge, which means the exposure from a single incident can extend to multiple people in ways that aren’t obvious at the scene.
Penalties for a VTL §1182 Conviction in New York
Because street racing is a class A misdemeanor, the consequences run deeper than points on a license.
First conviction: A fine of $300 to $525 and up to 30 days in jail.
Second conviction within 12 months: A fine of $525 to $750 and up to 6 months in jail.
